The National Conciliation and Mediation Board in Bacolod has deemed the notice of strike filed by the CENECO Union of Rational Employees (CURE) against Central Negros Electric Cooperative (CENECO) not filed.
The Notice of Strike was filed on November 15 on behalf of CURE by Felix Gepilga Jr. as its president.
The notice cited unfair labor practice through alleged multiple violations of the mandatory provisions of their Collective Bargaining Agreement, and the continuous interference and harassment of the CURE office secretary.
NCMB Branch VI OIC Director II Rene Sabordino in a letter to Gepilga dated Nov. 21 cited a Department of Labor and Employment order reinstating Marbie L. Cabardo as CURE vice president who shall perform the obligations and responsibilities of acting president until a union president is elected.
The General Assembly on Oct. 27, 2023 cited by Gepilga does not in any way indicate that Cabardo called and presided over it as acting union president, Sabordino said.
Hence, said “General Assembly resolution is not sufficient proof of your authority to file a Notice of Strike”, Sabordino wrote Gepilga.
“We cannot take cognizance of your Notice of Strike for lack of legal personality to file the same,” he said.*
