NegOcc PLO to file motion for reconsideration on CSC order reinstating dismissed lawyer

The Negros Occidental Provincial Legal Office (PLO) will file a motion for reconsideration to a Civil Service Commission’s (CSC) ruling that set aside the 2020 dismissal of Attorney IV Ernie E. Magaspag and ordered his immediate reinstatement with full backwages.

 Provincial Legal Officer Alberto Nellas Jr. said  on Wednesday, July 15, that the provincial  government has 15 days to file the appeal, maintaining that their original decision to dismiss the lawyer is firmly supported by substantial evidence on record.

Nellas said that filing the motion for reconsideration will effectively put Magaspag’s court-ordered reinstatement on hold while the case is reviewed.

The11-page CSC decision promulgated on June 17, ruled that the  administrative case against Magaspag lacked substantial evidentiary support.

According to the CSC, the case originally grew out of an anonymous complaint submitted on August 30, 2019, which claimed that multiple lawyers at the Provincial Legal Office were habitually tardy or absent.

In a separate administrative update, Nellas said  that Wednesday marked the end of the 60-day preventive suspension for two provincial government engineers who previously headed the Silay Oxygen Plant at the Teresita L. Jalandoni Provincial Hospital in Silay City.

While their preventive suspension period has officially concluded, Nellas said that both engineers are still undergoing formal administrative hearings regarding their formal charges for the alleged mismanagement of the oxygen facility.*
