A graphic artist caught making a fake business permit was sentenced to six months to two years and four months imprisonment after pleading guilty to the charge of falsification of public document.
Judge Michael Hanz Villaster of the Municipal Trial Court in Cities Branch 3 in Bacolod City meted the penalty on Jaymoun Barrera Oliveros, NBI Bacolod executive officer Jose Gabriel Jr. said on Tuesday, May 14.
NBI agents apprehended Oliveros for producing a fake business permit at a portrait shop at Bargain Square Mall in downtown Bacolod in February.
The NBI conducted the operation on the request of the Bacolod City government to crack down on persons responsible for the production of fake business permits, Gabriel said.
When Oliveros’ case was called for arraignment, Oliveros pleaded guilty of the crime.
The judge, considering the mitigating circumstance of a plea of guilt, sentenced Oliveros to suffer the indeterminate penalty of imprisonment of six months to two years, four months and one day.
Considering the conviction of the accused, his counsel moved that he be allowed to enjoy provisional liberty under the same bond while he avails of post-conviction remedies, which the court granted.
In case the post-conviction remedies are not availed of, the court shall issue an order of arrest for service of sentence, the judge said in his order.
Lawyer Inban Cristales of the Public Attorney’s Office said Oliveros application for probation was granted by the court.*
