Posting of any size of campaign materials on private property not a violation: Comelec

Candidates and partylist groups can post campaign materials and billboards in any size and shape as long as they are located on private property, Regional Director Lionel Marco Castillano of the Commission on Elections-Negros Island Region said Friday, Feb. 28.

If they have permission from the owners of the private property, no restrictions on campaign materials will be imposed, he said.

What is prohibited is the posting of campaign materials on trees, poles and public structures, Castillano said.

The posting of campaign materials in public places is only allowed in common poster areas, he said.

Those violating the rule against posting campaign materials on public property will be given a three-day notice to take them down, Castillano said.

Failure to remove illegally posted campaign materials within three days will lead to Comelec’s filling of cases for disqualification from running for public office against the culprits, he said.

Those who insist on posting campaign materials on trees will face charges not only for violation of the Fair Election Act, but also of the Forestry Law, Castillano said.*
