Employers who refuse to pay SSS delinquencies to face raps

The Social Security System will be constrained to file criminal complaints against employers who fail to respond to Show Cause Orders for them to pay their delinquencies, Lilani Benedian, SSS vice president for Visayas West 1 Division, said Friday, August 5.

SSS officials served six more Show Cause Orders to non-compliant employers in Bacolod City on Friday as part of the SSS Run After Contribution Evaders (RACE) campaign.

Employers who continue not to pay contributions for their workers will face criminal complaints for violation of Republic Act 11199 or the Social Security Act of 2018.

Benedian said they have started serving Show Cause Orders to the top 20 percent of the delinquent employers covered by their SSS Bacolod East and Bacolod branches.

If employers closed their businesses or reduced their employees during the COVID-19 pandemic they must show proof, she said.

However, they must pay for their pre-pandemic delinquencies, and those incurred after they resumed operations, she added.

 Employers are given 15 days from receipt of their Show Cause Orders to agree on options for the settlement of their delinquencies, which can be done on installment.

The SSS Bacolod and Bacolod East branches have listed 1,911 employers under their jurisdictions with P81 million in contribution delinquencies, some of whom have already paid their obligations.

Not remitting SSS contributions is just one of the violations, Benedian said. They are also going after employers who do not pay the true monthly salary credits of their employees, or under report the number of their workers, she said.

Also tagged as violators are persons who have failed to register their businesses and employees with the SSS, Benedian said.

Employers must pay the SSS premiums of their employees regularly so they can avail of the benefits due them, she added.*
